To whom it may concern,
My reason for the letter is not to have infringement notices reduced or cleared, but to tell the story of how I have been victimized and mistreated by the Metro Police. I have already paid my Infringement notice of R500 that has been reduced from R2500 as stated on the duplicate.
On Saturday 25 February 2017, I drove on the R511 between Hartbeespoortdam and Diepsloot. I, Annelien Pienaar, xxxxxxxxxxxxx, had to over take a vehicle after it has stopped at a speed of 100km/h suddenly. I maneuvered my car to avoid an accident by moving into the opposite lane of oncoming traffic. At that stage there were no oncoming traffic and the chances of me going onto the dirt road at 100km/h was not safe to do so. So, I did cross solid lines.
When I was stopped the police officer came to my window and asked me why I have overtaken a vehicle and endangered oncoming traffic. I very politely explained to the officer what happened and I asked him, how he did not see what happened, because he saw me do the offende. I handed my drivers license to the younger officer still asking me. “do you know what you have done?” So I say...I have explained what I have done and do take full responsibility for my actions: “Please give me the ticket, I need to go to work.” The older officer gets out of the vehicle and order me to get out of my vehicle he is going to arrest me, and put me in the van. So, I immediately started to doubt who they are and asked the officers to show me their ID documents, which they just ignored. The older officer said to me that I am not at liberty to ask or tell them to do anything because they are the law and I am under arrest.
I shut my window and phoned my husband desperately to ask him to come and assist. I also phoned the Hartbeespoortdam police station and they reacted immediately. Unfortunately the area where I were stopped, were remote and at least 25 min drive from my home and Hartbeespoort. So for at least 30 minutes I had to endure the older officer shouting, telling me to get out of my vehicle and also showing me a weapon with the words: “I will enforce the law”. At that stage I were wrecking my brain what is my rights as a road user? Well, I know that I can ask them to follow me to the nearest police station in an orderly manner. So, I opened my window and tell them I am going to drive to Erasmia station and they can arrest me there, because I don’t trust them to be legal or officers of the traffic law. The older officer yelled back at me that if I were to leave, they will use force and how can I not trust the law...he is the law! I then stated we must wait for my husband and the police, my husband can take my car and they can arrest me in front of him and the police and put me in the van. The officer started to get very angry with me and order the younger officer to remove me from my vehicle and the officer should drive my car. So, now I really get out of my mind scared. I say to the officer that it will be illegal for someone that is not on my insurance to drive my car and this will be seen as my car was stolen by the officer. I really tried to play for time for the police to arrive.
So I asked for the paperwork to be completed and my ID to be returned to me, because I saw how the officer put it into his pocket. The younger officer were less vocal and done everything as instructed by the older officer. While doing the paperwork, I took my chance to take photographs of the officers and they jumped (as per evidence) into the van to avoid being photographed. The older officer came back and said he has arranged extra manpower to assist him in arresting me. So in a few minutes time a lady officer in a Bantam bakkie and a civilian heavily armed stopped at the scène. She never spoke a word but was standing at a distance. The older officer keep on shouting at me...that he is the law and how stupid am I not to get out of my vehicle and even asked me if I am drunk...then I started laughing and cracked. I asked him directly how much will buy me my freedom? Because as he told me time and again...that I will not get bail until Monday. So he go to the back end of the van and knock on the door: "I will take a million rands but ten thousand will do it." The next moment we heard the sirens of the police and the younger officer throws the notice at me and told me.: “You can leave”. Got into the van and disappeared. The lady officer were sitting in her bakkie and I drove aside her and asked her, what her part is in all of this and how can I just be arrested without a warrant. She said that road users should comply and do as instructed. She did not interfere because it was not her jurisdiction.
Dear sir or madam reading this...clearly this whole event were premeditated. Even at the point where the car stopped in front of me...I think this is not per accident!
I have paid my dues...now we need to inspect these officers.

Ek dink meeste van ons ken nie ons regte ten opsigte van situasies soos hierdie nie. Ek het van oraloor inligting ingewin en die saak is nou oorhandig aan die Anti-Fraud unit en ook ‘n advokaat wat spesialiseer in die soort van sake.
Wat moet jy doen as jy so iets teë kom? Indien dit soos in my geval ’n situasie is waar offisiere met net een voertuig langs die pad staan, is dit vir een rede en dit is om “omkoop” geld te ontvang. Dit is egter veilig om by 'n pad blokkade te stop. Ek het nog nie al die antwoorde nie...maar...dit is wat ek nou uitgevind het en dit sal jou dalk uit so ‘n traumatiese situasie red.
Jy het die reg om:
• Met jou nood flikkerligte stadig tot by die naaste polisiekantoor te ry en aan te dui hul moet jou volg volg.
- Iemand te bel en ook die polisie te ontbied.
Die Verkeersbeamptes mag:
• Jou arresteer vir dronkenskap, gevaarlike en nalatige bestuurspraktyke soos heen en weer oor die pad sweef, oor ‘’n rooi lig ry of ‘’n stopstraat, sonder ‘n lasbrief.
Die Verkeersbeamptes mag nie:
• Jou voertuig bestuur nie. Die nodige sleep voertuie moet gereël word en so verwyder word.
• Met jou vir ure in die vangwa rondry nie. As jy gearresteer word moet jy dadelik na die naaste plek van aanhouding geneem word. Hulle mag nie met jou in die voertuig sit en wag nie.
• ‘n Manlike offisier mag nie vroulike motoriste deursoek nie, net ‘n vroue offisier mag, so ook andersom.
